Roofing failures highlight Ohio county court case


Recently, Columbiana county commissioners relayed that they have agreed to a settlement in a two-year lawsuit they had been waging against a local contractor over a design flaw.

In 2005, the county opened its municipal court; however, soon after, the court began experiencing roofing leaks, which led officials to further investigate, the Salem News reports. The problems continued and got worse during the next few years, which led the commissioners to pay someone else to fix the faults.

"It's the most frustrating thing I've been involved since I've been a commissioner," commissioner Penny Traina, told the paper.

In 2009, the county commissioners, fed up with the error, filed a lawsuit against the contractor, claiming the design, construction and installation of the roof was faulty. Furthermore, they sought reimbursement for their expenditures, stating the contractor should claim professional liability for the errors.

No monetary figures have been released regarding the settlement, however, Traina relayed that the county had to pay more than $185,000 because of the errors and lawyer fees. The county had opted to go with a Columbus-based law firm instead of a county prosecutor because of the complexities of the case.
