Oklahoma tribe opposes construction of wind turbines on its land


The Osage Nation has filed a lawsuit against Wind Capital Group, Osage Wind and WC Investment Management over its plans to construct wind turbines on its land, the Tulsa World reports.

Overseeing the case is U.S. District Judge Gregory Frizzell, who set a trial date just two months after the lawsuit was filed. Normally, lawsuits take months and years to get to trial, the news source suggests, but Judge Frizzell found the implications surrounding the lawsuit so vital to the immediate future of the local neighborhoods that he expedited the trial process. The project is also under a strict deadline in order to qualify for tax credits.

Osage nation requested the trial to be delayed in order to do additional research, but Frizzell doesn’t find it necessary to do so.

"[The] plaintiff has not persuaded this court that the discovery necessary for trial cannot be completed in that time, that plaintiff's experts cannot adequately review the project engineering layout and design in that time and that it would be not feasible to try this matter beginning on Dec. 14."

According to the complaint, Osage Nation opposes the digging of the 94 wind turbines due to the environmental effects it may create. Any damage done to Osage Nation's property due to engineering mistakes may be covered by professional liability insurance.
