New York transit system sued for ADA failures

Officials for the Metro Transit Authority in New York recently relayed that it will adjust the Dyckman 1 train station to incorporate access for handicapped users, DNAInfo.com reports.

This announcement came after much turmoil recently involving the MTA's failure to comply with the Americans with Disabilities Act. Disability advocacy groups had stated some of the MTA's stations failed to provide adequate access for people with handicaps.

In 2010, the MTA announced it would spend $24 million to overhaul the Dyckman station. However, this project did not include adjustments to comply with ADA standards. Following this announcement, a class-action lawsuit was filed against the MTA by the United Spinal Association. As a result, the MTA now plans to make the station compliant with ADA regulations.

"Installing elevators during scheduled station renovations goes far to promote transportation access for people who use wheelchairs," James Weisman, senior vice president and general counsel for the United Spinal Association, told the news source. "This is a significant resolution that will enhance subway access for all users of the station with mobility challenges."

The case highlights the importance of companies complying with industry regulations, lest they face expensive professional liability lawsuits that could ruin their business.
