Lawsuit filed over water park construction errors

A St. Louis-based firm may soon be filing an errors and omissions insurance claim, as a local town is suing the company for what it says is a construction error.

According to the Belleville News-Democrat, officials from Swansea, Illinois, say a water facility designed for use by local children was improperly constructed, and could cause residents to be electrocuted if there is a storm or a malfunction.

Officials told the paper workers for Diverse Construction did not property ground the electricity before finishing installation.

However, Diverse Construction says it does not pose any electrical risk, and that the firm completed the project as it was designed. The paper says the firm offered to redo the project for a fee, but the town is suing to have that work completed for free because of a breach of contract.

This kind of legal battle could cause issues for a small business owner who is facing legal action even though they may have completely fulfilled the terms of the contract. Having affordable errors and omissions coverage can help small business owners continue to grow their company.
