Lady Gaga involved in marketing suit

An Illinois-based company is now involved in a marketing lawsuit with pop superstar Lady Gaga over its newest line of products which use her name.

The pop singer, whose name is actually Stefani Germanotta, is suing Excite Worldwide, which has applied for trademarks for the names "Lady Gaga" and "Lady Gaga LG" for cosmetics and other items.

In the suit, she says that the company is interfering with her own trademark applications for her line of products created by her company, Ate My Heart, which would include candles, wigs, bags, tattoos and other items. She added that the conflict could cause consumers to think that she was associated with the new line of items - called "Lady Gaga by Design" - even though she is not.

Excite Worldwide declined to comment about the issue when contacted by The Associated Press.

The incident highlights the need for marketing professionals to be aware of any copyright or trademark conflicts which may exist with a particular campaign along with sufficient professional liability insurance to be protected from a potentially expensive lawsuit.
