Whistleblower claims: A growing concern for small business owners

Published:

There are a number of different lawsuits small business owners need to protect themselves from, and the list may be growing due to new litigation stemming from retaliation and whistleblower claims, in which employees can report safety or quality assurance concerns to employers or the government, according to Fox Business.

“There is a perception that there is a wrong to be righted here," Eric Savage, shareholder at Litter Menelson P.C. law firm, told the news source. "[Whistleblower statutes] shift the burden of truth, so that the employer has to prove that they would have taken the same action if the plaintiff hadn’t filed a whistleblower claim.”

These types of claims demonstrate why employers need to conduct the proper training and compliance to ensure employees know their rights and when it is time to report internal issues within the workplace, added Savage.

Businesses can protect themselves from these suits by documenting all aspects of employee performance and involving human resources throughout the process, said the news source. Business insurance policies can also help firms financially against these types of claims.
