What employers need to know when injured employees return

FindLaw.com recently provided information regarding what employers need to know to accommodate workers who are returning to the job after being away with an injury.

Workers injured on the job are entitled to a number of benefits as a results of workers compensation, which include "temporary partial" benefits that are paid to temporarily disabled employees, usually based on a percentage of their wages, said the website. The website said despite the fact they are returning to work, workers may still be entitled to workers compensation benefits, depending on the benefits an employee received while away.

Another thing employers need to keep in mind when injured employees return to work is that retaliatory actions may be against the law, which include things such as discrimination, harassment or wrongfully terminating an employee due to workers compensation claims.

Many businesses have to deal with confusion about what is covered under their workers compensation plans, given the circumstances of particular situations. For example, Business and Legal Resources recently outlined a case in which an employee was injured when her own vehicle rolled backward while the worker was unlocking a gate at the school where she worked. The question of whether she was injured in the course of doing her job had to answered by a court, which determined she was entitled to workers compensation.
