Texas refinery workers lawsuit file for overtime wage failures

According to recent reports, two former employees of a Texas refinery have sued the establishment for professional liability failures, claiming it did not pay them adequate overtime wages.

In their lawsuit, the ex-employees allege the refinery required or permitted them to work more than 40 hours per week without paying them properly. In addition, the workers claim they were sometimes "on call" for 24 hours, but were not compensated for this time either. Both plaintiffs believe they are eligible for overtime wages being salaried, nonexempt employees under the Fair Labor Standards Act.

One plaintiff had worked at the company for nearly 15 years before the lawsuit was filed. The other had been with the company for more than seven years.

The men filed the lawsuit in the Southern District of Texas on Friday, September 16.
