Pennsylvania passing bill that will limit negligence liability

Recently, the Pennsylvania Senate voted in favor of a bill that will limit the liability of defendants in court cases involving negligence.

By a vote of 32-18, the Senate sent the bill to the state's House, which many believe will quickly approve. If that does take place, Governor Tom Corbett would then be able to sign into law one of his top priorities.

Currently, all defendants found guilty in such court cases are liable to 100 percent of the damages if co-defendants are unable to pay for their negligence that resulted in death or injury to a body or property. The new law would prevent defendants from paying more than their share.

Some of the bill's supporters feel it could hurt the state's businesses, as lawyers could bring in larger businesses, some of which are vaguely related to cases, in order to help cover any bills the defendant wouldn't be able to pay. However, the bill's opponents feel that changing this law will ultimately hurt any victims of negligent acts and their families.

"This is a bill that's been identified by every business organization that I'm aware of in the state as a No. 1 priority to help them create jobs in this commonwealth," said Senate Appropriations Committee chairman Jake Corman. "This is a bill that the healthcare organizations have been strongly supportive of to help them keep their viability in their communities."
