Ohio AG sues now-closed dental chain

Published:

Ohio Attorney General Mike DeWine recently filed a lawsuit against Allcare Dental, claiming the now-closed chain failed to provide its patients with items they paid for.

In addition to Ohio, the New York-based dental chain affected thousands of customers throughout 12 other states when it closed its doors in January.

DeWine's filing states that Allcare failed to deliver products or refunds to its clients that had paid for dental work and dentures. By failing to meet these obligations, DeWine claims the company violated Ohio's Consumer Sales Practices Act, which protects consumers from any unfair or deceptive sales maneuvers.

The case could because interesting, however, as the act exempts "transactions between dentists and their clients."

Allcare's closing was quite abrupt, which caught almost all of its nearly 1,000 customers in Ohio by surprise. Many of these customers had been left in mid-treatment, which drew the lawsuit.

Regardless of how the case plays out, this battle highlights the need for companies to have business insurance in place in case any unforeseen situations arise, such as court fees. Furthermore, having the insurance in place to handle any professional liability cases is important for companies in all sectors.
