Lawsuit filed against Dish Network for failing to pay overtime wages


According to reports, a lawsuit has been filed against a Dish Network affiliate in Louisiana for allegedly failing to pay several technicians overtime wages.

The employees filed their lawsuit on August 31 in a federal court in New Orleans. The suit claims three technicians, who install and service equipment for Integrated Electronic Technologies, were termed incorrectly, which resulted in the company skirting their overtime wages. According to IET, the workers were classified as "independent contractors," a move the plaintiffs feel was done only for the company to avoid paying payroll taxes and various other employment benefits.

During a given week, the technicians claim they work between 60 and 90 hours, and so far, they have not been paid overtime wages. Employees that work more than 40 hours in a workweek are entitled to overtime pay under the Fair Labor Standards Act and Alabama, Mississippi and Louisiana law.

The plaintiffs seek an injunction against their employer from allowing it to continue mislabeling workers. In addition, they hope to receive compensatory and punitive damages, interest, attorneys' fees and court costs.

The case highlights the importance of companies correctly classifying employees and paying them in accordance to federal and state labor laws. Failing to do so may result in similar professional liability lawuists, and may damage a company's reputation.
