Copyright, patent lawsuits filed against IronKey

Technology firm IronKey, which provides data protection and is known for thumb drives, is currently engaged in several legal battles. 

Both copyright and patent lawsuits have been filed against the technology company by Securework, a San Jose-based software business. Securework's filing claims IronKey licensed software from it in 2006 and paid $30,000 in royalties, however, the company breached its contract when it did not pay further royalties after releasing more products. In addition, Securework claims IronKey "failed to acknowledge" the company's copyright on all IronKey products that used its licensed software.

Furthermore, Securework stated that IronKey has continued to market and distribute these productions without making any additional royalty payments.

Including infringement violations, Securework has alleged IronKey is guilty of breach of license, trade secret misappropriation and unfair competition. The amount of damages it is seeking has yet to be released.

The case highlights the need for companies to be aware of all contractual agreements and client or vendor relationships. Entering into professional liability lawsuits can become expensive, and can ultimately sink a small business which does not have proper insurance coverage.
